ELECTORAL AMENDMENT BILL: NATIONAL ASSEMBLY HOME AFFAIRS COMMITTEE AGREES TO NCOP PROPOSALS

The National Assembly’s Home Affairs Committee has issued a media statement confirming the adoption of changes to the Bill proposed in a ‘C’ list discussed at its most recent meeting. These will be incorporated in a ‘D’ version of the Bill, which the committee expects to consider soon clause by clause, adopt and table in the House with the necessary report. According to the committee’s statement, the new amendments focus on ‘the quota of seats required from independent candidates to stand’, and ‘the role of the executive’ once the Bill has been signed into law.

They stem from changes to the Bill’s ‘B’ version recommended by the NCOP in November 2022 and sent to the Home Affairs Committee for concurrence. The following month, stakeholders were given an opportunity to make written submissions on what was being proposed. This public commentary period ended on 27 January 2023.

The Bill is therefore in the closing stages of its passage through Parliament.

Once enacted and in force, it will give effect to a 2020 Constitutional Court ruling requiring the Act to make provision for independent candidates to contest elections to the National Assembly and the provincial legislatures.
