ELECTRICITY GENERATION: DRAFT PROCUREMENT PLANNING REGULATIONS OUT FOR COMMENT

The Department of Mineral Resources & Energy has gazetted draft regulations intended to facilitate planning for the procurement and establishment of transmission capacity by private parties. Input is sought by 3 May 2025.

Developed under the 2006 Electricity Regulation Act, once in force the proposed new regulations will apply to:

  • determinations-related consultation requirements
  • determinations on transmission capacity procurement from transmission service providers, and
  • matters with possible implications for effective determinations implementation.

It is envisaged that, once finalised, the new regulations would not apply to the yet-to-be-established Transmission System Operator SOC Ltd.

Against that backdrop, issues covered in the proposed new regulations include:

  • deviation from:
    • independent resource plan imperatives, and
    • a transmission development plan yet to be published
  • feasibility studies
  • cross-border transmission capacity, and
  • cost recovery.
