The National Assembly’s Mineral Resources & Energy Committee has completed its work on the Electricity Regulation Amendment Bill and National Nuclear Regulator Amendment Bill, having made changes to both pieces of proposed new legislation. This is according to a report on each Bill tabled last week in the House. However, at the time of writing only the changes made to the Electricity Regulation Amendment Bill were available.
Tabled in August 2023, among other things that particular Bill provides for ‘an open market platform that will allow for competitive electricity trading’. To that end, once passed, enacted and in force, it will:
As a section 76 piece of legislation affecting the provinces, the Bill must be subjected to a robust public participation process under the auspices of each provincial legislature. It is therefore unlikely to complete its passage through Parliament until well after the May 2024 elections.
The National Nuclear Regulator Amendment Bill was also tabled in August 2023. Its overarching objective is to align the Act with International Atomic Energy Agency (IAEA) standards and ‘various international conventions governing nuclear safety’ to which South Africa is signatory.
