The draft Electricity Regulation Amendment Bill recently featured in parliamentary papers will only be published once it has been officially certified, at which point it will be introduced or tabled.
Rule 159 requires any Minister or Deputy Minister intending to introduce a Bill to submit a draft and explanatory memorandum ‘as soon as possible after … (it) has been approved by Cabinet’. These documents are then referred to the relevant committees, enabling members to familiarise themselves with the Bill’s contents and plan their programmes accordingly.
However, not all approved draft Bills are submitted before being certified.
As SA Legal Academy has already reported, an explanatory summary of the Electricity Regulation Amendment Bill was gazetted on 19 April 2023 – a week after Cabinet approved the Bill for tabling in Parliament. At the time, the draft Bill released in March 2022 for stakeholder input was the only document publicly available. It still is, as far as can be ascertained.
The March 2022 draft may well have been revised to accommodate some of the input received. As a result, material changes may have been made to some of its contents at the time.
