ELECTRONIC COMMUNICATIONS: ICASA PUBLISHES FINDINGS ON LOAD SHEDDING IMPACT INQUIRY

The Independent Communications Authority of South Africa (ICASA) has published a summary of information received during an inquiry into the impact of ‘various stages of load shedding’ on electronic communications and broadcasting. Initiated in December 2023, the inquiry sought to determine whether ‘regulatory relief measures’ are necessary.

Noting that ‘Eskom’s generation capacity … has not yet stabilised’ fully despite generation recovery plan implementation, according to the findings summary document ICASA will consider:

  • providing ‘regulatory forbearance to (affected) licensees on a case-by-case basis in terms of the existing regulations’, and
  • investigating possible amendments to regulations impeding licensees from full compliance with their regulatory obligations during loadshedding.

Given that ‘some’ regulations include provisions allowing licensees to apply for exemptions from certain requirements when encountering force majeure elements hindering compliance, ICASA ‘recommends that licensees continue to invest in renewable energy as a form of ensuring that their services continue to run effectively and efficiently when they experience loadshedding’.
