ELECTRONIC DEEDS REGISTRATION: DRAFT AMENDMENT BILL OUT FOR COMMENT

The Department of Agriculture, Land Reform & Rural Development has gazetted a draft Electronic Deeds Registration Systems Amendment Bill for input by 24 May 2024. Intended to improve the 2019 Act’s ‘application and implementation’, the draft Bill seeks to provide for the preparation, lodgement, registration and execution of deeds and related documents both electronically and manually.

According to a memorandum on the draft Bill’s objects, this is until such time as procedures in terms of the Deeds Registries Act, 1937, and Sectional Titles Act, 1986, are ‘discontinued’. A schedule to the proposed new piece of legislation provides details of the amendments envisaged for both these Acts, while Clause 2 amends existing transitional arrangements accordingly.
