ELECTRONIC DEEDS REGISTRATION & RECORDAL SYSTEMS: AMENDMENT BILL HEADS TO PARLIAMENT

Please note: On 16 September 2026, parliamentary papers announced that the draft Bill has been submitted to the National Assembly Speaker and NCOP chair for information and planning purposes only. Once certified by the Office of the State Law Adviser, it will be formally tabled. 2) Parliamentary papers have confirmed that the Bill was introduced on 22 September 2026. 

The Department of Land Reform & Rural Development has gazetted the procedurally required pre-tabling explanatory summary of an Electronic Deeds Registration & Recordal Systems Amendment Bill.

Approved by Cabinet at its meeting on 1 July 2026, according to a media statement issued at the time the proposed new piece of legislation is ‘largely technical in nature’. Its overarching objective is to ‘modernise the legislative framework governing deeds registration and recordal systems’, thus:

• ‘advancing the objectives of an inclusive economy and enhanced security of land tenure’, and
• ‘improv(ing) the administration of land and property rights for the benefit of landowners and rights holders’.

To that end the Bill proposes amendments to the 1937 Deeds Registration Act, 1986 Sectional Titles Act and 2019 Electronic Deeds Registration Act.
