ELECTRONIC DEEDS REGISTRATION: REGULATIONS GAZETTED, IN FORCE SOON

The Department of Agriculture, Land Reform & Rural Development has gazetted regulations giving practical effect to the 2019 Electronic Deeds Registration Systems Act, the phased commencement of which has yet to be concluded. The new regulations were released in draft form in November 2024 for public comment, as SA Legal Academy reported at the time.

In force from 3 April 2025, they prescribe requirements to be met and procedures followed in the context of:

  • user registration
  • record keeping (paper and electronic)
  • preparing deeds and related documentation
  • lodgement
  • electronic payments, and
  • deeds registration certificates.
