The Commission on Employment Equity has issued a media statement among other things expressing confidence that the Employment Equity Amendment Bill now waiting to be signed into law will curb 'malicious compliance' with employment equity and broad-based black economic empowerment (B-BBEE) legislation.
According to the statement, 'malicious compliance' is no more than a B-BBEE point-scoring exercise aimed at securing state contracts. It is not substantive compliance and does not embrace the transformative spirit and ethos of employment equity.
Once in force, the Bill will enable the Minister to determine sector-specific employment equity targets. Prospective bidders for state contracts will then be required to demonstrate that they meet these and related criteria.
