EMPLOYMENT EQUITY AMENDMENT BILL SIGNED INTO LAW

The Presidency has issued a media statement announcing that the Employment Equity Amendment Bill has been signed into law. This comes nearly eleven months after Parliament passed the Bill’s ‘B’ version. However, it is not clear from the statement when the new piece of legislation will come into effect. Neither the Act nor its associated regulations has been gazetted.

Nevertheless, as the statement notes, among other things once operationalised they will empower the Minister of Employment & Labour to:

  • set employment equity targets for economic sectors and regions ‘where transformation is lagging’, taking account of regionally specific racial demographics, and
  • regulate the compliance criteria to be met when tendering for state contracts.

It also exempts entities with less than 50 employees from complying with the burdensome employment equity administrative processes of:

  • conducting workplace analyses
  • preparing employment equity plans, and
  • submitting employment equity reports.
