EMPLOYMENT EQUITY: INPUT SOUGHT ON PLAN PREPARATION GOOD PRACTICE CODE

The Department of Employment & Labour has gazetted a draft code of good practice on preparing an employment equity plan – calling for public comments by 22 September 2026.

Unpacking each phase of the employment equity plan preparation process, among other things the draft code covers:

  • the structure of a plan
  • workplace, workforce, policy, procedural and practice analyses
  • assigning responsibility
  • inclusivity and consultation
  • communication and awareness
  • numerical targets
  • affirmative action
  • dispute resolution, and
  • reporting.

Once finalised, the code of good practice will apply to all designated employers required – in terms of the 1998 Employment Equity Act – to prepare, implement and monitor progress in achieving the targets of an employment equity plan, in consultation with employee and/or trade union representatives.
