EMPLOYMENT EQUITY REGULATIONS: REVISED DRAFT OUT FOR COMMENT

The Department of Employment & Labour has called for input by 27 May 2024 on a revised set of draft regulations proposing sector-specific numerical targets under section 15A of the Employment Equity Amendment Act, 2022. This is in anticipation of the Act’s commencement.

The move follows a decision by the department to finetune a May 2023 version of the draft regulations’ in the light of some stakeholder input received at the time (SAnews).

Once operationalised, the proposed new regulations will empower the Minister ‘to set different numerical targets for different occupational levels, sub-sets or regions within a sector’ – ‘or on the basis of any other relevant factor’. This is expected to ensure ‘the equitable representation of suitably qualified people from designated groups at all occupational levels’.
