ENVIRONMENTAL MANAGEMENT: DRAFT REGULATIONS ON MICROBEADS OUT FOR COMMENT

The Department of Forestry, Fisheries & the Environment has gazetted draft regulations intended to prohibit the use, production, distribution, sale, import and export of plastic microbeads, as well as all products containing them. Input is sought by 7 September 2025.

According to a departmental media statement on the draft regulations, they have implications for a raft of industries including pesticides, toiletries and cosmetics. Onerous penalties are envisaged for non-compliance.

Against that backdrop, it is proposed that entities in possession of microbeads when the regulations have been finalised and are in force should, among other things:

  • have 24 months’ grace before being penalised, and
  • during that time comply with monitoring and evaluation procedures included in the draft regulations.
