ENVIRONMENTAL MANAGEMENT: INPUT SOUGHT ON FINE-RELATED REGULATORY PROPOSALS

The Department of Forestry, Fisheries & the Environment has called for input by 14 June 2026 on proposed amendments to regulations under the 1998 National Environmental Management Act affecting fines for non-compliance. Focusing on the process of determining an appropriate fine, they seek to prescribe:

  • the procedure to be followed, and
  • the criteria to be considered.

The intention is to align regulations in place since July 2017 with the requirements of the principal statute’s section 24G, which:

  • was inserted by the 2022 amendment Act
  • has been in force since 30 June 2023, and
  • among other things makes a pre-authorisation public participation process mandatory.

Once in force, the amendments will also apply to authorisation applications submitted on or after 30 June 2023 and still pending at the time of publication.

As far as can be ascertained, there is no publicly available fully updated composite copy of the regulations as they now stand.
