The Department of Forestry, Fisheries & the Environment has issued a media statement drawing attention to draft amendment regulations apparently gazetted on 21 April 2023 for comment. The deadline for input has been extended to 22 May 2023.
According to the statement, three sets of amendments to the 2019 regulations are proposed. Each has implications for the procedure to be followed for adopting spatial tools or environmental management instruments.
Once finalised, one of the amendments will allow registration requirements to exclude certain activities ‘based on an adopted environmental management instrument, where deemed appropriate’.
The draft amendments may have fallen victim to a tendency to backdate notices that are then posted on the eGazette site among others genuinely released on that date. As a result, they disappear into the database and may occasionally be missed.
