ENVIRONMENTAL MANAGEMENT: PRINCE EDWARD ISLANDS

The Department of Forestry, Fisheries & the Environment has gazetted a notice calling for input by 21 January 2026 on the proposed adoption of a generic environmental management programme for Prince Edward Islands conservation purposes and related research.

The programme envisaged would exclude certain activities from pre-environmental authorisation requirements under the 1998 Environmental Management Act.

This is noting that the Islands:

  • were declared:
    • a ‘special nature reserve’ in 1995, under the 1989 Environment conservation Act, and
    • a marine protected area in 2013, under the 2003 National Environmental Management: Protected Areas Act, and
  • are managed and controlled under the 2003 Protected Areas Act.

Once finalised and in force, among other things the new regulations will prescribe the procedures to be followed:

  • by any party applying for an exemption, and
  • by the authorities:
    • processing applications
    • registering an exemption, and
    • amending, suspending or withdrawing it.

The proposed processing procedures include timeframes.

According to the notice, the extended commentary period takes account of the 15 December 2025 to 5 January 2026 festive season break.
