EXPROPRIATION BILL: NCOP COMMITTEE CALLS FOR WRITTEN SUBMISSIONS

The NCOP Committee on Transport, Public Service & Administration, and Public Works & Infrastructure has issued a notice calling for written submissions by 6 March on the Expropriation Bill’s ‘B’ version. Passed by the National Assembly on 28 September 2022, according to a memorandum on its objects the Bill seeks to provide:

  • ‘a common framework, in line with the Constitution, to guide the processes and procedures for expropriation of property by organs of state’, and
  • ‘for instances where expropriation with nil compensation may be just and equitable’.

As a Constitution section 76 piece of legislation affecting the provinces, the Bill is expected to be the focus of a robust public participation process - including hearings in Parliament and each provincial legislature.
