The NCOP has endorsed changes to the Expropriation Bill’s ‘B’ version recommended by its Transport, Public Service & Administration, and Public Works & Infrastructure Committee. Reflected in a document referred to as the ‘C’ list, the proposed amendments have been sent to the National Assembly committee concerned for concurrence.
As SA Legal Academy has regularly reported, once passed, enacted and operationalised the new piece of legislation will provide ‘a common framework in line with the Constitution to guide the processes and procedures for the expropriation of property by organs of state’. This is according to a media statement issued by the NCOP, which notes that the Bill also provides for ‘certain instances where expropriation with no compensation may be appropriate in the public interest’.
The Expropriation Act of 1975 will then be repealed.
At the time of writing, the ‘D’ version of the Bill incorporating ‘C’ list amendments was not yet available.
