EXTENSION OF SECURITY OF TENURE AMENDMENT ACT IN FORCE SOON

According to a recently gazetted presidential proclamation, the Extension of Security of Tenure Amendment Act, 2018, will come into force on 1 April 2024.

Among other things, this will formally establish and operationalise a Land Rights Management Board – along with land rights management committees tasked with identifying, monitoring and settling land rights disputes.

The expectation is that this will close loopholes in the principal statute found to have:

  • made the eviction of farm dwellers easier in certain circumstances, and to
  • allow the law to wrongly expose large populations of vulnerable occupiers’ families to undue eviction processes, especially upon the death of a primary occupant.
