FILMS & PUBLICATIONS ACT: INPUT SOUGHT ON DRAFT GUIDELINES AND CODE

The Film & Publications Board has gazetted three sets of proposals on which stakeholder input is sought by 8 September 2023.

One is a draft code intended, among other things, to address the burgeoning proliferation of ‘child sexual abuse material’. Once finalised, it will apply to all online distributors and social media platforms.

One is a draft guideline intended to assist the Appeals Tribunal in determining if content is harmful and/or prohibited. It focuses on assessing the potential for speech to be deemed hateful in the context of a constitutional framework that includes freedom of expression.

The third set of proposals takes the form of a draft guideline on peer-to-peer video sharing intended, among other things, to promote respect for copyright and intellectual property legislation.

  • Government Gazette notice
  • draft code on ‘preventing online harm’
  • draft guidelines on peer-to-peer video sharing
  • draft guidelines on determining ‘whether content is harmful’
