FINANCIAL INTELLIGENCE CENTRE ACT: MORE SECTIONS IN FORCE SOON

According to a recently gazetted presidential proclamation, four more sections of the 2001 Financial Intelligence Centre Act are scheduled to come into effect on 1 July 2026. This appears to suggest that the entire Act, as amended, could well become fully operational on that date.

The proclamation lists the following imminently effective provisions:

  • section 30 (cash or bearer negotiable instrument conveyance to or from South Africa, focusing on reporting obligations)
  • sections 54 and 55 (making it an offence not to report the conveyance of cash or bearer negotiable instruments into or out of South Africa), and
  • section 70 (related search, seizure and forfeiture powers).
