FINANCIAL SECTOR CONDUCT AUTHORITY: MORE PROPOSALS OUT FOR COMMENT

The Financial Sector Conduct Authority (FSCA) has called for input by 20 November 2023 on five documents outlining:

  • a draft equivalence framework for financial markets, and
  • a draft determination of requirements relating to external central counterparty or external trade repository licence applications.

According to the FSCA communication announcing this:

  • the draft equivalence framework focuses on the FSCA’s proposed approach when determining the status of a foreign jurisdiction’s regulatory framework in relation to regulatory frameworks established in terms of the Financial Markets Act, 2012, and the Credit Rating Services Act, 2012, while
  • the draft determination proposes ‘the form and manner in which an application for an external central counterparty licence or external trade repository licence’ should  be made.
