FINANCIAL SECTOR: INDEX, BENCHMARKS DRAFT DETERMINATIONS OUT FOR COMMENT

The Financial Sector Conduct Authority has published a discussion document on proposed determinations that, once finalised, will:
- add a caveat to the definition of ‘index’ in the Financial Sector Regulation Act, 2017, and
- prescribe value thresholds for critical and significant benchmarks.
The deadline for comment is 10 September 2024.
Informed by stakeholder input on a 2023 discussion document exploring the development of a framework for the regulation and supervision of financial benchmarks, the new discussion document follows the April 2024 release of a draft determination on the requirements to be met when licensing a benchmark administrator.
