FOREIGN FISHING VESSELS: INPUT SOUGHT ON DRAFT REGULATIONS

The Department of Forestry, Fisheries & the Environment has gazetted draft regulations under the Marine living Resources Act, 1998, on which input is sought by 18 February 2024.

Once finalised and in force, the proposed new regulations will:

  • ‘create a discreet notification and permitting procedure applicable to foreign fishing vessels that wish to traverse South African waters or enter into port’
  • provide such vessels with ‘certainty on the process and procedures’ to be followed before entering South African waters
  • ensure that South Africa is always ‘aware of the presence of foreign fishing vessels in its waters’
  • ensure the proper stowing of any fishing gear on board
  • minimise illegal, unreported and unregulated fishing, and
  • domesticate relevant aspects of the UN Food & Agricultural Organisation’s Agreement on Port State Measures, to which South Africa is party.
