FUNERAL INDUSTRY REGULATION: SALRC DISCUSSION PAPER PUBLISHED FOR COMMENT

The South African Law Reform Commission (SALRC) has called for input by 29 September 2023 on a discussion document published as the second step in its review of legislation regulating the funeral industry. This follows an issue paper released in October 2020 for general information and comment, with the paper reflecting some of the input received.

According to an accompanying media statement, the discussion paper proposes ‘the establishment of an ombud scheme and the adoption of a code of conduct for funeral service practitioners’.

In the SALRC’s view, a code of conduct would:

  • ensure the ‘transparent pricing of goods and services’, strengthening consumer protection
  • ‘promote and maintain acceptable standards of care and the provision of services that are reasonable and fair’, and
  • ensure adherence to health and safety regulations.

The paper also explores ‘the need for mandatory educational or training requirements for funeral directors, embalmers and other (industry) employees’.
