GAS BILL HEADS TO PARLIAMENT

Please note: Parliamentary papers have confirmed that the Gas Bill was formally tabled on 5 March 2025.
In anticipation of its formal introduction in Parliament, an explanatory summary of the Gas Bill has been gazetted outlining its overarching objectives. Approved by Cabinet in December 2025, once passed, enacted and operationalised the proposed new piece of legislation will repeal the 2001 Gas Act.
According to the Bill’s explanatory summary, it seeks to:
- provide for and promote the gas industry’s ‘orderly development’ [by ‘enhanc(ing) the national regulatory framework’]
- ‘promote broad-based black economic empowerment’
- provide for the industry’s ‘socio-economic and environmentally sustainable development’
- accommodate ‘new developments and changing technologies’
- ‘facilitate gas infrastructure development and investment’
- facilitate ‘co-operation between the private and public sectors’, and
- strengthen enforcement (thus improving compliance).
A media statement on the Cabinet meeting at which the Bill was approved also referred to provisions intended to:
- improve gas resource and infrastructure management ‘in line with global best practices and national energy priorities’
- empower the National Energy Regulator of South Africa to:
- ‘set, monitor and regulate distribution tariffs’
- ‘regulate the registration regime’, and
- determine ‘suitable’ licence timeframes, and
- centralise strategic planning for new gas transmission and regasification facilities.
Regarding provisions dealing with technological developments, the statement noted ‘gas transportation and storage’ in particular.
Not yet available, the Bill may have been informed to some extent by input on a draft Gas Amendment Bill released in January 2024 for public comment.
