GENERAL INTELLIGENCE LAWS AMENDMENT BILL: FINAL OPPORTUNITY FOR INPUT

Please note: On 19 April 2024, the committee issued a second notice calling for submissions on matters beyond the original scope of the Bill. Their inclusion in the Bill was authorised by the National Assembly. This SA Legal Academy report provides more details.  

The NCOP ad hoc committee established to process the General Intelligence Laws Amendment Bill during the final leg of its passage through Parliament has called for written submissions. However, the committee notice announcing this refers to the version tabled in November 2023, which has since been amended by the National Assembly committee concerned.

On 26 March 2024, the House passed a ‘B’ version of the Bill, which was sent to the NCOP for concurrence. It is presumably this version on which submissions are now sought by 12 May 2024.

Amendments made by the National Assembly seek to provide for:

  • the operational efficiency of the office of the Inspector-General of Intelligence, and
  • parliamentary oversight by the Joint Standing Committee on Intelligence.

As has been widely reported, the Bill’s overarching objective is to give practical effect to recommendations made by the Presidential High Level Review Panel on State Security.
