GNU CLEARING HOUSE MECHANISM: ToR FINALLY ADOPTED

The Government of National Unity (GNU) clearing house mechanism has ‘finally adopted its terms of reference’.

Established in September 2024 ‘to resolve policy disagreements within the 10-member GNU’, the clearing house met for the first time a month later – since when official media statements on its meetings have been few and far between. As far as can be ascertained, the only dispute ever formally declared was about certain policies underpinning the 2024 Basic Education Laws Amendment (BELA) Act. Regarding the controversial 2024 Expropriation and National Health Insurance Acts, a January 2025 Democratic Alliance press release tended to point to the possibility of a role for the clearing house mechanism in resolving both policy issues. However, no official GNU statements have been released on either matter.

According to a statement announcing the adoption of the mechanism’s terms of reference:

  • the GNU statement of intent is ‘foundational to the work of the GNU clearing house’
  • the clearing house will function as ‘a recommending body, not a decision-making structure’
  • GNU parties will ‘agree to disagree when consensus fails’
  • ‘sufficient consensus (will apply) ... only to decision-making bodies’ (the GNU and political leaders forum), not the clearing house
  • unresolved issues will be referred to the political leaders forum, not the President, and
  • the clearing house will not deal with provincial or local government matters.

Now a ‘living document’, the adopted terms of reference will be presented to the political leaders forum for ratification. However, at the time of writing they had yet to be made public. Meanwhile, the clearing house is expected to begin meeting monthly.
