HAZARDOUS CHEMICALS: ROTTERDAM CONVENTION DOMESTICATION REGULATIONS IN FORCE SOON

Revised regulations domesticating the 1998 Rotterdam Convention on international trade in hazardous chemicals and pesticides have been gazetted and will come into force in January 2025. This is according to a Department of Forestry, Fisheries & the Environment Government Gazette notice marking the end of a long process begun in January 2020.

First finalised and published in February 2023, the original regulations were scheduled to come into effect 120 days later. However, their commencement was postponed.

In October 2023, revised draft regulations were released for comment – with no explanation for the finalised version’s withdrawal, as SA Legal Academy reported at the time.

As before, the new regulations prohibit the export and import of certain chemicals and pesticides without prior informed consent. To that end, among other things they prescribe:

  • the procedures to followed
  • reporting and record keeping requirements, and
  • penalties for offences.
