HIGH COURT RULES: HEADS OF ARGUMENT PROPOSAL OUT FOR COMMENT

On behalf of the Rules Board for Courts of Law, the Department of Justice & Constitutional Development has published a notice calling for input by 31 March 2026 on a proposed new rule intended to regulate the preparation and filing of heads of argument in the High Court.

To be inserted in the Uniform Rules of Court, it is intended to be ‘general in nature and speak to the practice across all divisions of the High Court’ – at least, according to the covering letter. With that in mind, it proposes a list of the criteria to be met, which among other things covers:

  • writing style
  • source acknowledgement
  • referencing requirements
  • maximum number of pages, and
  • annexures.
