JUSTICE: MORE AMENDMENTS TO HIGH, MAGISTRATES’ COURTS RULES IN FORCE SOON

On 30 January 2026, substantive amendments to rules regulating the conduct of proceedings in provincial and local divisions of the High Court will come into effect. Gazetted on 24 December 2025, among other things the amendments:

  • provide for the use of the e-justice system across a wide range of procedures in courts where it is in force, and
  • have significant implications for leave to appeal procedures.

Also in force from 30 January 2026, an amendment to the Magistrates’ Courts rules inserts a definition of the term, ‘affidavit’.
