HOUSING PROTECTION AMENDMENT BILL SENT TO NCOP

The National Assembly has passed a ‘B’ version of the Housing Consumer Protection Bill, which has been sent to the NCOP for concurrence.

Not yet available, the Bill’s ‘B’ version is expected to reflect amendments listed a report tabled in the House in December 2022 by its Human Settlement Committee.

Once in force, the Bill will repeal the Housing Consumer Protection Measures Act, 1998. This is noting ‘certain challenges’ experienced in implementing ‘key provisions’. In addition, the Bill seeks to:

  • facilitate the industry’s economic transformation ‘through the introduction of provisions relating to the warranty fund surplus, which may be utilised towards developmental programmes for the homebuilding industry’, and
  • ‘create an enabling environment for new entrants into the home building industry through the introduction of contractual provisions that ensure their sustainability in the market’.
