HUMAN SETTLEMENTS: DRAFT WHITE PAPER OUT FOR COMMENT

Please note: On 28 February 2024, the department gazetted a notice extending the deadine for public comment to 15 March 2024. This followed a notice published on 26 January 2024 extending the deadine to 28 February 2024. 

The Department of Human Settlements has gazetted a draft White Paper for input by 31 January 2024. Intended to address a plethora of issues apparently rendering prevailing human settlements programmes ‘unsustainable’, among other things the draft White Paper identifies the need for legislative reform.

To that end, it is envisaged that the Housing Act, 1997, should be repealed and replaced with a Human Settlements Act. This is noting that ‘adequate housing’ not only entails ‘equitable access to land’. It requires municipalities to ‘properly plan for human settlements as a whole’ – among other things making them responsible for regulating building standards, as well as housing-related health and safety.

Against that backdrop, the draft White Paper explores:

  • sustainable housing subsidy options
  • informal settlement upgrading
  • affordable rental housing
  • funding models, and
  • governance.
