The Department of Human Settlements has gazetted a notice extending the deadline for input on a draft White Paper released in December 2023. This is the second time the deadline has been extended. The new deadline is 15 March 2024.
Intended to address a plethora of issues apparently rendering prevailing human settlements programmes ‘unsustainable’, among other things the draft White Paper identifies the need for legislative reform.
To that end, it is envisaged that the Housing Act, 1997, should be repealed and replaced with a Human Settlements Act. This is noting that ‘adequate housing’ not only entails ‘equitable access to land’. It requires municipalities to ‘properly plan for human settlements as a whole’ – among other things making them responsible for regulating building standards, as well as housing-related health and safety.
