IMMIGRATION AMENDMENT BILL: CALL MADE FOR SUBMISSIONS

In anticipation of parliamentary hearings, the National Assembly’s Home Affairs Committee has called for submissions by 22 November 2024 on the Immigration Amendment Bill.

Tabled in April 2024, the proposed new piece of legislation seeks to remedy provisions in the principal statute affecting illegal foreigners in detention. This follows two related Constitutional Court rulings handed down in June 2017 and October 2023 – and, as an interim measure, a March 2024 ministerial directive addressing the issues concerned.

Once passed, enacted and operationalised, the amendments are expected to ensure that the further detention and deportation of an illegal foreigner is determined by a court within 48 hours of their arrest. This is according to a memorandum on the Bill’s objects, which also notes provisions intended to serve as guidance to immigration officers and the courts in exercising their detention powers.
