IMMIGRATION REGULATIONS: DRAFT AMENDMENTS OUT FOR COMMENT

The Department of Home Affairs has called for input by 29 March 2024 on a second set of draft amendments to regulations under the Immigration Act, 2002. The regulations have been in force since May 2014, operationalising the 2011 Immigration Amendment Act.

The first set of amendments to the 2014 regulations was gazetted in November 2018 and incorrectly given draft status. This was eventually rectified in September the following year.

The changes now envisaged have implications for:

  • corporate, work, visitors’ and temporary ‘sojourn’ visa applications
  • permanent residence applications, and
  • applications to reside in South Africa ‘on other grounds’.
