IMMIGRATION REGULATIONS: REPLACEMENT AMENDMENTS GAZETTED

The Department of Home Affairs has gazetted a revised second set of amendments to regulations in place since May 2014 under the Immigration Act, 2002. Immediately in force, they replace amendments published on 28 March 2024 and withdrawn two weeks later. This is noting that:

  • the process of developing the amendments was informed by comments received on a draft version released in February 2024, and that
  • according to Cliffe Dekker Hofmeyr’s Taryn York, the withdrawn final amendments:
    • were published before the end of the public commentary period, and
    • caused ‘confusion’ among some stakeholders.

Shortly before withdrawing them, Home Affairs Minister Aaron Motsoaledi reportedly said that ‘the substance of the regulations … would remain the same (Taryn York, Cliffe Dekker Hofmeyr).

As before, they affect:

  • corporate, work, visitors’ and ‘temporary sojourn’ visa applications
  • permanent residence applications, and
  • applications to reside in South Africa ‘on other grounds’.
