IMMIGRATION REGULATIONS: SECOND SET OF AMENDMENTS GAZETTED AND IN FORCE

Please note: 1) On 9 April 2024, Home Affairs Minister Aaron Motsoaledi issued a media statement giving context to and explaining the new regulations 2) On 12 April 2024, a notice was gazetted withdrawing the new regulations, a revised version of which will be published 'in due course'.

The Department of Home Affairs has gazetted a second set of amendments to regulations under the Immigration Act, 2002. In place since May 2014, the regulations were first amended in 2018.

Released in draft form in February 2024 for public comment, the latest set of amendments are now in force and affect:

  • corporate, work, visitors’ and ‘temporary sojourn’ visa applications
  • permanent residence applications, and
  • applications to reside in South Africa ‘on other grounds’.
