In anticipation of parliamentary hearings in 2026, the National Assembly’s Co-operative Governance & Traditional Affairs Committee has called for written submission by 23 January 2026 on the Intergovernmental, Monitoring, Support & Interventions Bill.
Tabled in April 2025, once enacted and operationalised the Bill will regulate:
- national executive interventions in provinces in terms of section 100 of the Constitution, and
- provincial executive interventions in municipalities in terms of section 139 of the Constitution.
This is noting that:
- the Constitution’s sections 100 and 139 enable such interventions when a provincial or local government cannot or does not fulfil its executive obligations, and that
- while the 2003 Local Government: Municipal Finance Management Act does provide for interventions to address financial challenges faced by municipalities, there is no legislation providing for discretionary interventions.
