INTERNATIONAL CRIMES BILL WITHDRAWN FROM PARLIAMENT

Recently published parliamentary papers have confirmed that the International Crimes Bill tabled in 2017 has been withdrawn. The Bill’s purpose was to close gaps in domestic legislation should South Africa proceed with plans to withdraw from the Rome Statute of the International Criminal Court (ICC).

These plans surfaced following a Cabinet decision in October 2016, in terms of which the UN Secretary General was notified of South Africa’s intentions. Five months later, however, the Gauteng High Court (Pretoria) ruled that the decision has been unconstitutional – and the withdrawal notice was revoked. This notwithstanding, Justice & Correctional Services Minister at the time, Michael Masutha, was quoted as having said that government was nevertheless still ‘considering its options’. Presumably with these in mind, the Bill was tabled in December 2017.
