IPID AMENDMENT ACT 2019 IN FORCE SOON

Please note: On 29 August 2025, most sections of the 2024 IPID amendment Act came into force by presidential proclamation.

The 2019 Independent Police Investigative Directorate (IPID) Amendment Act will come into effect on 29 November 2024 by presidential proclamation in the Government Gazette. This new piece of legislation partially responds to a 2016 Constitutional Court judgment on the directorate’s institutional and operational independence. Popularly referred to as the McBride judgment, among other things the ruling focused on provisions in the principal statute allowing the Minister of Police to suspend or remove the IPID’s executive director and to take any disciplinary steps pursuant to suspension.

In keeping with the ruling, the 2019 amendment Act provides for parliamentary oversight in relation to such steps. This is noting that other aspects of the judgment are addressed in a separate amendment Act, which joined the statute books in July 2024 but at the time of writing had yet to be operationalised.
