IPID: DRAFT REGULATIONS GAZETTED FOR COMMENT

The Department of Police has gazetted a notice calling for input by 24 December 2025 on draft regulations under the 2011 Independent Police Investigative Directorate (IPID) Act.

Published on the IPID website, once in force the proposed new regulations will repeal and replace the February 2012 version – also giving effect to the 2024 IPID Amendment Act, most sections of which were commenced in August 2025. Possibly in anticipation of operationalising the remaining sections, issues covered in the draft regulations include:

  • pre-employment security and risk screening (affecting for all prospective directorate employees)
  • the appointment of investigators
  • conduct, financial disclosure, anti-corruption and ethics management
  • integrity testing and confidentiality
  • operational requirements
  • disciplinary matters, and
  • reporting requirements.

At the time of writing, draft forms mentioned in the Government Gazette notice were not available.

As SA Legal Academy has already reported, the amendment Act’s overarching objective was to align the principal statute with a 2016 Constitutional Court ruling popularly known as the McBride judgment. To that end, it focused on IPID’s institutional and operational independence – also providing for parliamentary oversight.
