JUSTICE: LATEST JUDICIAL MATTERS AMENDMENT BILL READY FOR TABLING

The Department of Justice & Constitutional Development has finally published the latest Judicial Matters Amendment Bill, which is about to be tabled in Parliament. Stakeholders were referred to the Bill in a 20 December 2024 Government Gazette notice serving as the required pre-tabling explanatory summary.

According to the notice, the proposed amendments to ‘numerous Acts … are intended to address practical and technical issues of a non-contentious nature, including compliance with a Constitutional Court judgment’.

Among other things, they have implications for:

  • the right of appearance in the High Court
  • the requirements for admission as a legal practitioner
  • the payment of professional fees, and
  • requirements for possessing a Fidelity Fund certificate.

They also seek to align the Child Justice Act, 2008, with the Cannabis for Private Purposes Act, 2024 in the context of procedures for dealing with children arrested for the possession or use of cannabis.
