JUSTICE: SMALL CLAIMS COURTS THRESHOLD RAISED

The Department of Justice & Constitutional Development has issued a media statement on a recently gazetted increase in the monetary jurisdiction of the Small Claims Courts. Effective from 1 August 2026, the R10 thousand increase is expected to facilitate the speedy, cost-effective and fair resolution of a larger volume of disputes – thus ‘ensuring that access to justice is determined by the merits of a case rather than a person’s financial means’.

The prevailing jurisdiction of R20 thousand has been in place since March 2019.
