LABOUR LAW: DRAFT DISMISSAL CODE OF GOOD PRACTICE OUT FOR COMMENT

The Department of Employment & Labour has called for input by 22 March 2025 on a draft code of good practice for dismissals. Its purpose is to guide employers, employees and trade unions on the application of their legal obligations under the 1995 Labour Relations Act regarding dismissal for misconduct, incapacity or operational requirements.

According to an introduction to the draft code, this is noting the importance of:

  • mutual respect between employers and employees
  • employment justice
  • the efficient operation of an employer’s business, and
  • the expeditious resolution of disputes.

Other factors considered include:

  • the special circumstances in which small businesses operate, and
  • rights and obligations under a collective agreement.
