LAND COURT ACT IN FORCE

Except for one section and amendments to certain pieces of legislation listed in its schedule, the Land Court Act, 2023, came into effect on 4 April 2024. This is according to a presidential proclamation gazetted the following afternoon. In addition to establishing the Land Court and providing for related administration and judicial functions (including appeals), the Act deals with mediation procedures and amends a raft of laws relating to the adjudication of land issues by other courts.

Section 37 prescribes matters on which the Minister may make regulations and is not yet in force. Amendments to the following Acts are not yet in effect:

  • Upgrading of Land Tenure Rights Act, 1991
  • Land Reform: Provision of Land & Assistance Act, 1993
  • KwaZulu-Natal Ingonyama Trust Act, 1994
  • Communal Property Associations Act, 1996
  • Interim Protection of Informal Land Rights Act, 1996
