LAND TENURE RIGHTS: DRAFT REGULATIONS OUT FOR COMMENT

Please note: On 1 March 2024, the department gazetted a notice extendng the deadline for input to 15 March 2024. This is noting that, on 30 November 2023, the draft regulations were re-gazetted – presumably with the intention of extending the deadline for comment at the time by a further 10 days, although this is not expressly stated.  

The Department of Agriculture, Land Reform & Rural Development has prepared draft regulations under the Upgrading of Land Tenure Rights Act, 1991, and is calling for input by 17 December 2023 on what is proposed.

Once finalised and operationalised, the new regulations will:

  • prescribe the procedures to be followed when applying for the conversion of a land tenure right into an ownership right
  • require the Minister to issue a notice of application, prescribing the information to be included
  • prescribe the procedures to be followed when objecting to the conversion of a land tenure right to an ownership right, and
  • should the application be successful, require the Minister to notify the registrar accordingly.
