LAND TENURE RIGHTS: REGULATIONS GAZETTED ON CONVERSION TO OWNERSHIP RIGHTS PROCESS

Please note: 1) On 24 April 2024, a notice was gazetted withdrawing the new regulations. No explanation was provided. 2) On 24 May 2024, the regulations were gazetted again – with a presidential proclamation declaring the Upgrading of Land Tenure Rights Amendment Act, 2021, effective from 1 June 2024.

The Department of Agriculture, Land Reform & Rural Development has gazetted regulations under the Upgrading of Land Tenure Rights Act, 1991:

  • prescribing the procedures to be followed when applying for the conversion of a land tenure right into an ownership right
  • requiring the Minister to issue a notice of application, prescribing the information to be included
  • setting out the procedures to be followed when objecting to the conversion of a land tenure right to an ownership right, and
  • when an application is successful, requiring the Minister to notify the registrar accordingly.

The new regulations came into force on 1 April 2024. They were released in draft form in November 2023 for public comment, as SA Legal Academy reported at the time.
