LAW COURTS RULES: MORE DRAFT AMENDMENTS OUT FOR COMMENT

On behalf of the Rules Board for Courts of Law, the Department of Justice & Constitutional Development has issued a notice calling for input by 30 September 2026 on more draft amendments to the Magistrates’ Courts rules. Their purpose is to provide for ‘the revival of a rule nisi’ where the applicant concerned once again fails to appear in court. This would be in line with provisions in the Uniform Court Rules.
According to the correspondence concerned, once finalised and in force the proposed new rule would also seek to ensure that:
- no presiding officer revives a rule nisi without formally applying to do so, and that
- ‘the rule so revived need not be served again’.
