The Department of Justice & Constitutional Development has posted a notice on its website calling for input by 2 September 2026 on proposed amendments to Magistrates’ Courts and Uniform Rules affecting exceptions and strike out applications.
According to a Rules Board for Courts of Law letter dated 6 July 2026, the intention is to ‘promote greater procedural consistency’. To that end, the proposed amendments seek to:
Interestingly, the Rules Board letter gives stakeholders until 4 September 2026 to comment. Notwithstanding the discrepancy in dates, this would have allowed stakeholders a full month to make submissions had the department published the notice immediately.
